On December 12th, the Department of Health and Human Services (HHS) released an interim final rule extending the enrollment and payment deadlines for consumers purchasing coverage through an Exchange. 

 

The final rule gives individuals and small employers until December 23, 2013 to sign up for an Exchange plan that begins on January 1, 2014 and requires health insurance issuers to accept payment through December 31, 2013, for coverage that will begin January 1, 2014.

 

Note that state-based exchanges may have dates that vary, so please check with the individual state site for up-to-date information.  For example, Minnesota (MNsure) has just extended enrollment for individuals to December 31, 2013 with payment due by January 10, 2014.

 

In addition, individuals currently enrolled in the federal Pre-Existing Condition Insurance Plan (PCIP) will be allowed to extend their coverage through January 31, 2014 if they have not already selected a new plan.

 

To further complicate things, HHS announced that online applications for federal SHOP Marketplace small group coverage will be delayed for one year – to enrollment in 2014 for 2015 coverage. 

 

If you are in a state with a state-facilitated exchange marketplace, you are encouraged to check to see how they are handling the SHOP marketplace.  In Minnesota, for example, MNsure is encouraging small employers to work with their agent/broker to attain SHOP coverage.

 

In either case, small employers will still be required to purchase a SHOP plan in order to receive the Small Business Health Care Tax Credit – and can do so through an agent, broker, or insurer that offers SHOP plans.
